Are prediction markets legal in Delaware?
Yes. Delaware runs sports betting through its state lottery and has taken no enforcement action against prediction markets that we could find. Its Attorney General has joined other states in court briefs and a comment to the CFTC arguing that states may regulate sports event contracts as gambling.
Of the 56 platforms we review, 11 are open in Delaware, 6 with restrictions and 26 not at all; for 13 the terms do not say. Sports betting in Delaware: legal, run by the Delaware Lottery as a “sports lottery” (delcode.delaware.gov).

State court orders block some contract categories in Nevada, Washington and Michigan; elsewhere its contracts are available. Kalshi is in litigation with about 20 states, so this can change quickly.
