Are prediction markets legal in Washington?

Mostly not. Washington’s Gambling Commission says event-based contract markets are not authorised there, and a King County court order bars Kalshi’s sports, politics, entertainment and several other categories. Robinhood and OG have agreements with the state while their federal cases are stayed. Sports betting is legal only at tribal casinos.

    US District Court, W.D. Wash. (NADEX d/b/a OG v. Brown, 2:26-cv-02579). OG/NADEX sued on 22 Jul 2026. The AG and WSGC stipulated not to enforce state law against OG's DCM event-contract trading, and the case is stayed pending the related Ninth Circuit appeals (stipulation filed 18 Aug).

Under a stipulated order, the state will not bring certain enforcement actions over Robinhood's trading of DCM event contracts, and the case is stayed until the Ninth Circuit rules.
