Are prediction markets legal in North Carolina?

Yes. From 1 January 2027, North Carolina’s 2026 budget law says CFTC-registered prediction markets, sports contracts included, may operate lawfully in the state, and taxes their trading fees at 6%. Its Attorney General has still joined multistate briefs arguing states can regulate sports contracts. Sports betting is legal through Lottery Commission licensees.

Of the 56 platforms we review, 12 are open in North Carolina, 5 with restrictions and 26 not at all; for 13 the terms do not say. Sports betting in North Carolina: legal, licensed by the North Carolina State Lottery Commission (ncgaming.gov).

    North Carolina General Assembly and Governor Josh Stein (S.L. 2026-41, Senate Bill 257). Section 44.9 of the 2026 Appropriations Act adds G.S. 105-113.131: a prediction market registered with the CFTC that offers event contracts, including sporting event contracts, 'may operate within the State lawfully', and its operator owes a 6% tax on net trading fee revenue from North Carolina residents. The tax imposes no state licence or registration.
