Are prediction markets legal in Minnesota?

Yes, for now. Minnesota made it a felony to host or advertise most prediction markets from 1 August 2026, but on 27 July a federal court barred the state from enforcing that law against CFTC-registered exchanges until the cases are decided, warning that final relief may be narrower. Sports betting is not legal in Minnesota.

Of the 56 platforms we review, 12 are open in Minnesota, 5 with restrictions and 26 not at all; for 13 the terms do not say. Sports betting in Minnesota: not legal (Minn. Stat. § 609.76, subd. 2, makes sports bookmaking a felony) (revisor.mn.gov).

    U.S. District Court, D. Minn. (Judge Menendez). In the consolidated CFTC, Kalshi and Polymarket US cases, the court enjoined Minnesota from enforcing Minn. Stat. § 609.7615 against CFTC-registered designated contract markets until a final decision, finding the plaintiffs likely to succeed at least in part on express preemption. The order notes the statute may not be preempted in all its applications and that permanent relief may be much narrower.
