Are prediction markets legal in South Dakota?

Yes. South Dakota has taken no enforcement action against prediction markets that we could find. Sports betting is legal on the premises of licensed Deadwood casinos, and the state’s Attorney General has joined multistate briefs and a comment letter to the CFTC arguing that states can regulate sports contracts.

Of the 56 platforms we review, 12 are open in South Dakota, 5 with restrictions and 26 not at all; for 13 the terms do not say.
